THE CORPORATION OF THE CITY OF BURLINGTON

 

BY-LAW NUMBER 114-1992

 

A By-law to designate property known as 2083 Maria Street, being Part of Lots 6, 7, and 8, Block 'D', Registered Plan 92 in the City of Burlington, Regional Municipality of Halton, as property having historical and architectural value and interest pursuant to the Ontario Heritage Act.

 

WHEREAS by Section 29(6)(a) of the Ontario Heritage Act, R.S.O. 1990, chapter 0.18, as amended, the Council of a Municipality shall pass a by-law designating property to be of historical and architectural value and interest where no Notice of Objection to the designation has been served on the City Clerk within thirty days after the date of first publication of the Notice of Intention to designate in a newspaper having general circulation in the Municipality;

 

AND WHEREAS Notice of Intention to designate 2083 Maria Street was published in a local newspaper and served on the Owners of the property and on the Ontario Heritage Foundation by registered mail;

 

AND WHEREAS the reasons for the said designation are set out in Schedule "A" attached hereto and forming part of this by-law;

 

AND WHEREAS no Notice of Objection was served on the City Clerk of the City of Burlington.

 

NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF BURLINGTON HEREBY ENACTS AS FOLLOWS:

 

1.  THAT 2083 Maria Street more particularly described in Schedule "B" attached hereto and forming part of this by-law, be designated as being of architectural and historical value and interest.

 

2.  THAT the City Clerk be directed to cause a Notice of this by-law to be published in a local newspaper having general circulation in the Municipality.

 

3.  THAT the City Clerk be directed to cause a certified true copy of this by-law to be served upon the Owners of 2083 Maria Street and upon the Ontario Heritage Foundation.

 

4.  THAT this By-law shall take effect on the date of its registration in the Land Registry Office for the Land Registry Division of Halton (No. 20).

REASONS FOR DESIGNATION

 

2083 MARIA STREET

"The Old Metcalfe House" was built in 1885 by John Metcalfe on a market garden lot that extended north to Emerald Street, from Martha Street almost to Pearl Street.  The house remained in the Metcalfe family until it was sold in 1971 by Metcalfe's daughter, Annie Grace Sisson.  Her brothers, William (born in 1885) and Edgar, with their father, built two houses on severed lots on Maria Street (2089 and 2091) and two or more on Martha Street. 

 

The Metcalfes are a representative family of second and third generation residents whose trades and occupations were essential to the town of Burlington.  John Metcalfe, born in Nelson Township, married Cecilia Wheeler of the village of Appleby, the daughter of a Scottish immigrant gentleman farmer.  William, a carpenter, was chief of the volunteer fire department, foreman of the town's works department, and a member of the Sons of England Lodge.  Edgar, a plumber, owned a shop located at the comer of Brant and James Streets.  Grace met her future husband while working in Bell's apple orchard, just north of Caroline Street. 

 

Their home is a good example of a modest but substantial and comfortable Vernacular style dwelling.  A one-and-a-half storey front gabled red brick house, it is similar to others built in the 1880's in the village of Burlington, especially 367 Smith Avenue and 461 Burlington Avenue.  The simple bay window and unadorned arched windows of the front facade have pleasant proportions.  The front entrance and kitchen entrance doors have shallow-arched transoms but no sidelights; the side and rear windows have similar shallow arches.  Much original glass remains.  Both entrance doors, with panels and glazing, are original.  The side verandah has been removed; it might be replaced, with suitable documentation of its original form.  The former summer kitchen has been renovated for use as a studio and showroom for art and antiques.  Further renovations could be suitable, but not eligible for grant assistance.

Part of Lots 6, 7, and 8, Block 'D', Registered Plan 92, City of Burlington, Regional Municipality of Halton; and more particularly described as follows:

 

ALL AND SINGULAR that certain parcel or tract of land and premises situate, lying and being in the City of Burlington, in the Regional Municipality of Halton (formerly Town of Burlington, in the County of Halton), and being composed of part of Lots 6, 7 and 8 in Block "D" according to a plan filed in the Registry Office for the said County as Number 92 and which said parcel may be more particularly described as follows:

 

COMMENCING at a point in the north westerly limit of Maria Street distant one hundred and twenty and twenty-eight one hundredths feet (120.28') south westerly thereon from the south westerly limit of Martha Street;

 

THENCE south westerly along the north westerly limit of Maria Street forty-three feet (43.0') to an iron bar at the most southerly angle of said Lot 6;

 

THENCE north westerly along the south westerly limit of Lots 6, 7 and 8 one hundred and thirty-one and twenty-four one-hundredths feet (131.24') to an iron bar in the south westerly limit of Lot 8 distant fifty feet (50.0') south easterly thereon from the north westerly limit thereof;

 

THENCE north easterly and parallel to the north westerly limit of said Lot 8 forty-two and ninety-two one-hundredths feet (42.92') to an iron bar distant one hundred and twenty feet (120.0') measured south westerly along the said parallel line from the south westerly limit of Martha Street;

 

THENCE south easterly and parallel to Martha Street fifty-one and nineteen one-hundredths feet (51.19') to an iron bar distant eighty feet (80.0') measured north westerly along the said parallel line from the north westerly limit of Maria Street;

 

THENCE south easterly in a straight line eighty feet (80.0') more or less to the point of commencement.
