THE CORPORATION OF THE CITY OF BURLINGTON

 

BY-LAW NUMBER 120-2000

 

A By-law to repeal By-law 8-1995, from vacant land described as Part Lot 6, Concession 3 NS designated as PART 1, Plan 20R-5606

 

WHEREAS the City of Burlington passed By-law 8-1995 on the 13th day of February, 1995 to designate certain properties within the municipality as having historical, architectural value and interest under Section 29(6)(a) of the Ontario Heritage Act, R.S.O. 1990, c. 0.18, as amended;

 

AND WHEREAS By-law 8-1995 was registered on title to lands described as Part Lot 6, Concession 3 NS designated as PARTS 1, 2 and 3, Plan 20R-5606 municipally known as 6042 Guelph Line;

 

AND WHEREAS the subject property was the severed into two parcels pursuant to the consent provisions of the Planning Act.  The parcel containing the historical structure is described as PART 2, Plan 20R-5606.  The severed vacant parcel is described as PART 1, Plan 20R-5606;

 

AND WHEREAS the historical designation contained in By-law 8-1995 was inadvertently registered against vacant lands for which it does not apply.

 

NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF BURLINGTON HEREBY ENACTS AS FOLLOWS:

 

1.  THAT By-law 8-1995 registered March 14, 1995 as Instrument Number 835756 is hereby repealed from the lands described as Part of Lot 6, Concession 3 NS designated as PART 1, 20R-5606.

 

2.  THAT in all other respects By-law 8-1995 be and the same is hereby confirmed.
