THE CORPORATION OF THE CITY OF BURLINGTON

 

BY-LAW NUMBER 78-2007

 

A by-law to amend sign by-law 34-2007 with respect to fines for non-compliance.

 

WHEREAS subsection 11(1), paragraph 7 of the Municipal Act, 2001, S.O. 2001, c.25, authorizes the City of Burlington to pass by-laws respecting signs; and

 

WHEREAS it is deemed necessary to amend By-law 34 - 2007

 

NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF BURLINGTON HEREBY ENACTS AS FOLLOWS:

 

That By-Law Number 34-2007, be amended by adding Section 8.10.4 and 8.10.5 as follows:

 

1.  8.10.4 “Every person who contravenes any provision of this By-law is guilty of an offence and upon conviction is liable to a fine not exceeding $5,000.00 for each offence exclusive of costs.  Each day such violation is committed, or permitted to continue, shall constitute a separate offence and may be punishable as such there under.  Such fine shall be recoverable under the Provincial Offences Act.”

 

8.10.5 “ Where a person has been convicted of an offence under this By-law the Court may in addition to any other penalty imposed on the person convicted, issue an order prohibiting the continuation or repetition of the offence or the doing of any act or thing by the person convicted, directed toward the continuation or repetition of the offence.”

 

2.  THAT in all other respects By-law 34-2007 be and is hereby confirmed.
