THE CORPORATION OF THE CITY OF BURLINGTON
BY-LAW NUMBER 82-1996
A By-law to designate property known as St. Paul’s Presbyterian Church and Cemetery, in the City of Burlington, in the Regional Municipality of Halton, as property having historical and architectural value and interest pursuant to the Ontario Heritage Act.
WHEREAS by Section 29(6)(a) of the Ontario Heritage Act, R.S.O. 1990, chapter 0.18, as amended, the Council of a municipality shall pass a by-law designating property to be of historical and architectural value and interest where no Notice of Objection to the designation has been served on the City Clerk within thirty days after the date of first publication of the Notice of Intention to Designate in a newspaper having general circulation in the municipality;
AND WHEREAS Notice of Intention to designate St. Paul’s Presbyterian Church and Cemetery was published in a local newspaper and served on the owners of the property and on the Ontario Heritage Foundation by registered mail;
AND WHEREAS the reasons for the said designation are set out in Schedule “A” attached hereto and forming part of this by-law;
AND WHEREAS no Notice of Objection was served on the City Clerk of the City of Burlington.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF BURLINGTON HEREBY ENACTS AS FOLLOWS:
1. THAT St. Paul’s Presbyterian Church and Cemetery, more particularly described in Schedule “B” attached hereto and forming part of this by-law, be designated as being of architectural and historical value and interest.
2. THAT the City Clerk be directed to cause a Notice of this by-law to be published in a local newspaper having general circulation in the municipality.
3. THAT the City Clerk be directed to cause a certified true copy of this by-law to be served upon the owners of St. Paul’s Presbyterian Church and Cemetery and the Ontario Heritage Foundation.
4. THAT this by-law shall take effect on the date of its registration in the Land Registry Office for the Land Registry Division of Halton (No. 20).

SCHEDULE “A”
REASONS FOR DESIGNATION
St. Paul’s Presbyterian Church and Cemetery
St. Paul’s, one of the oldest Presbyterian congregations in Ontario, began in 1816 with services conducted in the barn of Hugh McLaren and the house of Gilbert Bastedo, who in 1822 gave part of his land for the construction of a frame church. The pioneer cemetery dates from 1817. In 1867 a brick church was built at a cost of $1500.00. It is a very fine example of a simple one-storey front-gabled brick church. Its large Gothic arched windows with interlocking lancet stone mullions, original small panes of coloured pressed-pattern glass, and brick hood mouldings, are exceptional design features. The church is one of the outstanding landmark heritage structures on historic Dundas Street.

Thence South Forty-four degrees, two minutes, fifty seconds East (S 44d 02’ 50” E) along the Southwesterly limit of Blocks nineteen (19) and seventeen (17), respectively of the said Plan 20M-519, 69.20 metres to an iron bar defining the Southerly corner of the said Block seventeen (17);

Commencing at an iron bar defining the Westerly corner of block nineteen (19), Plan 20M-519;
Thence continuing North fifty degrees, five minutes West (N 50d 05’ W), 7.72 metres to a point on the Southeasterly limit of Kings Highway Number 5, also known as Dundas Street;
Thence North thirty-nine degrees, twenty minutes, seventeen seconds East (N 39d 23’ 17” East) along the Southeasterly limit of the said Highway Number 5, 40.12 metres to the Northerly corner of Lot thirteen (13), Concession one (1), South Side of Dundas Street;
