THE CORPORATION OF THE CITY OF BURLINGTON
BY-LAW NUMBER 84-1995
A By-law to designate property known as 1457 Ontario Street, Plan 92, Part Lots 1, 2 Block W, in the City of Burlington, in the Regional Municipality of Halton, as property having historical and architectural value and interest pursuant to the Ontario Heritage Act.
WHEREAS by Section 29(6)(a) of the Ontario Heritage Act, R.S.O. 1990, chapter 0.18, as amended, the Council of a municipality shall pass a by-law designating property to be of historical and architectural value and interest where no Notice of Objection to the designation has been served on the City Clerk within thirty days after the date of first publication of the Notice of Intention to Designate in a newspaper having general circulation in the municipality;
AND WHEREAS Notice of Intention to Designate 1457 Ontario Street was published in a local newspaper and served on the owners of the property and on the Ontario Heritage Foundation by registered mail;
AND WHEREAS the reasons for the said designation are set out in Schedule A attached hereto and forming part of this by-law;
AND WHEREAS no Notice of Objection was served on the City Clerk of the City of Burlington.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF BURLINGTON HEREBY ENACTS AS FOLLOWS:
1. THAT 1457 Ontario Street, more particularly described in Schedule B attached hereto and forming part of this by-law, be designated as being of architectural and historical value and interest.
2. THAT the City Clerk be directed to cause a Notice of this by-law to be published in a local newspaper having general circulation in the municipality.
3. THAT the City Clerk be directed to cause a certified true copy of this by-law to be served upon the owners of 1457 Ontario Street and the Ontario Heritage Foundation.
4. THAT this by-law shall take effect on the date of its registration in the Land Registry Office for the Land Registry Division of Halton (No. 20).

SCHEDULE A
REASONS FOR
DESIGNATION
1457 ONTARIO
STREET
Built c.1875 for Robert Miller, former Reeve of Nelson Township and newly appointed Collector of Customs for the Port of Wellington Square, this is the earliest known building by George Blair and one of the oldest extant brick residences in the former Village of Burlington. Its subsequent ownership by the George Bush family, links it to the long-established mens wear business, which has been in operation on Brant Street since 1921. The Miller-Bush House is particularly important in maintaining the character of the heritage buildings on Locust and Ontario Streets. Its location at the intersection of these streets balances and supports that of the former Calvary Baptist Church (now Eglise St. Philippe), also built in 1875.

ALL AND SINGULAR that certain parcel of tract of land and premises situate, lying and being in the City of Burlington, in the Regional Municipality of Halton and being those parts of Lots Numbers One (1) and Two (2) in Block W east of Locust Street, according to Plan No. 92 for the said City of Burlington particularly described as follows:
COMMENCING at a point on the south-easterly boundary of said Lot One (1) said point being seventy-nine feet (79) from the southerly corner of said Lot One (1);
THENCE south forty-two degrees fifty-nine minutes forty seconds west (42°5940W) along the said south-easterly boundary of said Lot One (1), seventy-nine feet (79) to the southerly corner of said Lot One (1);
THENCE north forty-six degrees twenty-eight minutes twenty seconds west (N46°2820W) along the south-westerly boundaries of said Lots One (1) and Two (2), one hundred and thirty-two feet (132) to the westerly corner of said Lot 2 (2);
THENCE north forty-two degrees fifty-nine minutes forty seconds east (N42°5940E) along the north-westerly boundary of said Lot Two (2), seventy-nine feet (79);
THENCE south forty-six degrees twenty eight minutes twenty seconds east (S46°2820E), one hundred and thirty-two feet (132) to the place of beginning, as described in Instrument No. 728598.
