THE

PARKING
BY-LAW 87-2007
A
BY-LAW TO REGULATE PARKING
WHEREAS
Section 11 of the Municipal Act, 2001,
authorizes municipalities to enact by-laws respecting matters within the sphere
of jurisdiction of municipal property, private property and highways, including
parking and traffic on highways,
NOW THEREFORE, THE COUNCIL
OF THE CORPORATION OF THE CITY OF BURLINGTON HEREBY ENACTS AS FOLLOWS:
PART I
DEFINITIONS
1.
DEFINITIONS
For
the purposes of this by-law, the following definitions shall apply:
“access card” means a card issued under the
authority of this bylaw;
“agent”
means a person authorized in writing by an owner to regulate parking on an
identified parcel of private property;
“authorized
emergency vehicle” means a fire department vehicle, a
police vehicle or an ambulance;
“boulevard”
means that part of the highway situated between the curb line and the property
line of the lot abutting the highway, but does not include a sidewalk or
shoulder; but does include any centre median strip or island separating two (2)
roadways;
“bus
stop” means an area marked by one or more signs
indicating such area to be for the sole use of transit vehicles in taking on or
discharging passengers;
“Chief
of Police” means the Chief of Police for the Halton
Regional Police Service or designate;
“commercial motor vehicle”
means a motor vehicle having permanently attached thereto a truck or delivery
body and includes ambulances, hearses, casket wagons, fire apparatus, buses and
tractors used for hauling purposes on the highways;
“commercial vehicle loading zone”
means an area designated by signs for the exclusive use of commercial motor
vehicles while actually engaged in loading or unloading merchandise and for the
time duration specified on the sign;
“Council”
means the Council of the Corporation of the City of Burlington;
“crosswalk” means:
(a)
that part of a highway at an
intersection that is included within the connections of the lateral lines of
the sidewalk on opposite sides of the highway measured from the curbs or, in
the absence of curbs, from the edges of the roadway, or;
(b)
any portion of a roadway at an
intersection or elsewhere distinctly indicated for pedestrian crossing by signs
or by lines or other markings on the surface;
“curb
line” means:
(a) where a curb
has been constructed, the line of the curb; or
(b) where no curb
has been constructed, the edge of the roadway;
“Director”
means the Director of the Transit & Traffic Department of the Corporation
of the City of Burlington or designate;
“disabled parking permit”
means a valid disabled person parking permit as issued by the Ontario Ministry
of Transportation or by another jurisdiction;
“disabled
parking sign” means a sign consisting of a ‘No
Parking’ symbol, the international symbol for the disabled and the words “By
Permit Only”;
“disabled
person” means any person who has been deemed to be disabled
by medical authority and who possess a valid disabled parking permit;
“driveway” means improved land, which
provides vehicular access to and from a highway to adjacent land;
“Fire
Chief” means the Fire Chief for the City of Burlington Fire
Department or designate;
“fire
route” means any private road, lane, ramp, part of a
parking facility or other means of vehicular access to or egress from a
building or structure designated by the Fire Chief under
the
Fire Protection and Prevention Act;
“highway” means
a common and public highway, street, avenue, parkway, driveway, square, place,
bridge, viaduct, or trestle, any part of which is intended for or used by the
general public for the passage of vehicles and includes the area between the
lateral property lines thereof;
“intersection”
means the area embraced within the prolongation or connection of the lateral
curb lines or, if none, then the lateral boundary lines of two or more highways
that join one and another at an angle, whether or not one highway crosses the
other;
“island”
means a portion of a highway so constructed or designed as to separate or
direct vehicular traffic onto specific portions of the highway;
“large
vehicle” means any vehicle having a vehicle
weight greater than two thousand, five hundred (2,500) kilograms (5,500
pounds).
“Local
Board” means a municipal service board, transportation
commission, public library board, board of health, police services board,
planning board, or any other board, commission, committee, body or local
authority established or exercising any power under any Act with respect
to the affairs or purposes of one or more municipalities, excluding a school
board and
a
conservation authority;
“loading
zone,” means an area designated by signs for the exclusive
use of motor vehicles while actually engaged in the loading or unloading of
merchandise and only for the time duration specified on the sign;
“median strip” means the portion of a highway so constructed as to
separate traffic travelling in one direction from traffic travelling in the
opposite direction by a physical barrier or a raised or depressed paved or
unpaved separation area that is not intended to allow crossing vehicular
movement;
“motorcycle”
means
a self-propelled vehicle having a seat for the use of the driver and designed
to travel on not more than three (3) wheels and includes a motor scooter, but
does not include a motor assisted bicycle;
“motor
vehicle” means an automobile, motorcycle, motor
assisted bicycle unless otherwise indicated in the Highway Traffic Act and any other vehicle propelled or driven
otherwise than by muscular power but does not include a street car, or other
motor vehicles running only upon rails, or a motorized snow vehicle, traction
engine, farm tractor, self-propelled implement of husbandry or road-building
machine within the meaning of the Highway
Traffic
Act;
“Municipal Law Enforcement
Officer” means any person authorized by the
Corporation of the City of Burlington to enforce parking by-laws and shall
include Parking Enforcement Officers, Provincial Offences Officers and Halton
Regional Police Officers;
“municipal
parking facility permit” means a permit issued by the
Corporation of the City of Burlington to park a motor vehicle within a
designated municipal parking facility for the specified duration;
“municipal
parking facility” means lands, lots or structures that
have been set apart, designated or established by the Corporation of the City
of Burlington for the parking of motor vehicles;
“municipal property” means
real property owned by the Corporation of the City of Burlington other than
municipal parking facilities and highways;
“owner”
means:
(a) the registered
owner of a property;
(b) the registered
owner of a condominium unit;
(c) the spouse of a
person as set out in sub-paragraphs (a) or (b);
(d) any agent of an
owner;
(e) any tenant of
an owner;
“park” or “parking”
means the standing of a vehicle, whether occupied or not, except when standing
temporarily for the purpose of and while actually engaged in loading or
unloading merchandise or passengers;
“parking machine”
means an electronic or mechanical device for the purpose of controlling and
regulating the parking of any motor vehicle in or on a municipal parking
facility and which, when a coin has been inserted therein and the machine
activated, issues a document indicating the date and time of such activity and
the duration in or on a municipal parking facility permitted thereby;
“parking
machine receipt” means a card or other printed record
issued by a parking machine related to a municipal parking facility, the date
of issue and period of time in or upon which and during which parking is
authorized by that printed card or other document;
“parking meter”
means an electronic or mechanical device, for the purpose of controlling and
regulating the parking of any motor vehicle in a parking space and measuring
and indicating the parking time for which payment has been made and indicating
when such time has elapsed;
“parking
meter zone” means a highway or parts of a highway
designated for the use of and which is controlled by one or more parking
meters;
“parking
permit” means a document that has been issued by the
Corporation of the City of Burlington to allow a person to park in a
particular place at a particular time;
“parking
space” means a portion of a highway, municipal property or
private property that has lines painted or marks on the surface and is
designated for the parking of a vehicle;
“private property”
means real property owned by persons, other than property owned by the
Corporation of the City of Burlington and includes real property
owned by individuals, local boards, corporations and public authorities;
“private
road” means a lane, ramp, or other means of vehicular
access to or egress from a building or structure and may include part of a
parking facility;
“public
authority” means the Corporation of the City of
Burlington, the Halton Regional Police Service, the Regional Municipality of
Halton, the Province of Ontario or the Federal Government of Canada;
“public parking area”
means a structure or open area other than a street or highway, used for parking
of motor vehicles, to which the public has access, whether on payment of fee or
otherwise;
“roadway”
means the part of the highway that is improved, designed or ordinarily used for
vehicular traffic, but does not include the shoulder and where a highway
includes two or more separate roadways, the term ”roadway” refers to any one
roadway separately and not to all of the roadways collectively;
“shoulder”
means that part of a highway lying adjacent to the roadway where there is no
barrier curb and which is improved with granular or paved surface, which
extends from the roadway for a maximum distance of three (3) metres;
“sidewalk”
means that portion of a highway between the curb line and the property line of
the lot abutting the highway and which is intended for the use of pedestrians;
“sign”
means any device installed or placed on a highway, private property or the
Corporation of the City of Burlington property for the purpose of regulating
the parking and stopping of motor vehicles installed by the Corporation of the
City of Burlington on any property or, in the case of private property, the
owner, tenant or occupant of the property on which the sign is installed;
“stop” or “stopping”
means the halting of a vehicle, even momentarily, whether occupied or not,
except when necessary to avoid conflict with other traffic or in compliance
with the direction of a Police Officer, or of a traffic control sign or signal;
“tow
away zone” means any area designated by this
by-law and indicated by an appropriate sign, where a vehicle may be towed away
at the owner’s expense;
“unauthorized
motor vehicle” means any vehicle that does not have
identification issued and displayed in accordance with the provisions of this
by-law;
“utility vehicle” means
any vehicle that provides service of gas, hydro, telecommunications;
“vehicle”
includes a motor vehicle, trailer, traction engine, farm tractor, road-building
machine, bicycle and any vehicle drawn,
propelled or driven by any kind of power, including muscular power, but does
not include a motorized snow vehicle or
a streetcar;
“wheelchair”
means a chair mounted on wheels driven by muscular or any other kind of power
and used for the carriage of a person who is physically challenged.
2. INTERPRETATION
1. Where words and phrases used in this
by-law are defined in the Highway Traffic
Act, but not defined in this by-law, the definitions in the Highway Traffic Act shall apply to such
words and phrases.
2. Where abbreviations are used to
designate highway names in this by-law they shall be deemed to mean the
following:
(a)
Ave. shall mean Avenue;
(b) Blvd. shall mean Boulevard;
(c) Crt. shall mean Court;
(d) Cres. shall mean
Crescent;
(e) Dr. shall mean Drive;
(f) Ln. shall mean Line;
(g) Pl. shall mean Place;
(h) Rd. shall mean Road;
(i) St. shall mean Street;
(j) Com. means Common.
3. EXPRESSION OF TIME
In
this by-law, any expression of time shall be calculated as standard time except
in periods when daylight saving time is declared to be in effect, where upon
time shall be calculated as daylight saving time.
4. SCHEDULES and SEVERABILITY
1. Schedules
The schedules
attached to this by-law, are included in and shall be considered part of this
by-law.
2. Severability
If a
Court of competent jurisdiction declares any section or part of a section of
this by-law invalid, it is the intention of Council that the remainder of the
by-law shall continue to be in force and effect.
PART II
ENFORCEMENT
5. ENFORCEMENT
1. A
Municipal Law Enforcement Officer or other person authorized to enforce the Provincial Offences Act, is hereby
vested with the authority of administering and enforcing the provisions of this
by-law.
2. The
Director shall have the authority to install all signs required to enforce the
terms and regulations of this by-law.
3.
It is the express intent of Council that
any regulation, restriction or prohibition set out in this by-law shall be
deemed to include instructions to the Director to install all signs required to
enforce the terms and regulations of this by-law.
6. TOWING
Where
any vehicle is parked in contravention of this by-law, a Municipal Law
Enforcement Officer may cause it to be moved or taken to and placed or stored
in a suitable place at the owner’s expense.
All costs and charges for the removal, care and storage thereof, if any,
are a lien upon the vehicle that may be enforced in accordance with the Repair and Storage
Liens Act.
PART III
MUNICIPAL PROPERTY PARKING
7. MUNICIPAL PARKING FACILITIES
1.
The provisions
of this by-law shall apply to those municipal parking facilities as set out in Schedule “1”of this by-law.
2.
The lands as set
out in Schedule “1” of this by-law
are hereby set aside and established as municipal parking facilities for the
parking of vehicles.
3. The
manner in which parking is to be carried out in the said municipal parking
facilities shall be as prescribed in this by-law and it shall be an offence to
park in or on any of the specified municipal parking facilities in any manner
other than as prescribed by the terms of this by-law.
8. AUTHORIZATION TO OPERATE MUNICIPAL PARKING FACILITIES
The Director, for the purpose of controlling and
regulating parking in or on a municipal parking facility and for the purpose of
measuring and recording the time during which a vehicle has been parked and the
amount of fee to be collected, is hereby authorized to:
1.
Install, maintain and operate parking
machines, with the necessary
standards for same, in or on those municipal parking
facilities as set out in Schedule “1” of
this by‑law;
2.
Install, maintain and operate parking
meters, with the necessary
standards for same, in or on those municipal parking
facilities as set out in Schedule “1” of
this by‑law;
3.
Issue
and establish procedures for the issuance of monthly parking permits for those
municipal parking facilities as set out in Schedule
“1” of this by‑law;
4.
Establish
and operate reserved parking spaces as approved by Council;
5. Designate parking spaces by lines or
markings painted or placed upon the parking surface of parking facilities or
structures.
9. TYPES OF PARKING FACILITIES
1. Municipal Parking Facilities With Parking Machines or
Parking Meters:
(a)
Where parking
machines have been installed in a municipal parking facility as set out in Schedule “1” of this by‑law, the
period of time during which a vehicle is permitted to park shall be indicated
on the display of the parking meter or parking machine receipt provided by the
parking machine as the case may be;
(b)
In those municipal parking facilities,
as set out in Schedule “1” of this by-law where parking meters
have been installed, the period of time during which a vehicle is permitted to
park shall be governed by the display of that parking meter;
(c)
Notwithstanding sections 9.1(a)(b) and
save and except as set out in section 12 herein, no person shall park a
vehicle at any one parking space in any municipal parking facility or at one
parking meter for any period exceeding two (2) consecutive hours in any 24-hour
period.
2. Municipal Parking Facilities Without Parking Machines or Parking Meters:
The
parking of vehicles in those facilities, as set out in Schedule “1” of this by-law, that do not have parking machines or
parking meters is restricted to the times and dates as set out in Schedule “1” of this by-law.
3. Reserved Parking Spaces:
In
reserved parking spaces in parking facilities and structures, parking is
restricted to those vehicles or persons specified by the signs posted beside or
near such parking spaces.
10. THE PARKING OF VEHICLES IN PARKING SPACES
In a municipal parking facility, every person using a
parking space therein shall park totally within the parking space designated as
such by lines or markings painted upon the surface of the parking facility.
11. PARKING RATES
1.
The operator of every vehicle that parks
a vehicle in a municipal parking facility shall pay the parking rates in the
amount and manner as set out in Schedule “1”of this by-law.
2.
The rates in Schedule ”1”of this bylaw are subject to
change during festival and special event activities.
3.
Any reference to coins or currency in
this by-law or any of its schedules is a reference to Canadian currency.
12. MAXIMUM PERIOD FOR PARKING
1.
The maximum period for continuous
parking at any one time shall be as set out in Schedule “1” of this
by-law.
2. In the absence of evidence to the
contrary, a vehicle that is seen to be in the same municipal parking facility
between the times as set out in Schedule “1” of this by-law shall be
presumed to have remained in that municipal parking facility throughout that
period of time.
13. PERMITS AND ACCESS CARDS
1.
The Director is hereby authorized to
issue parking permits and access cards.
2.
The holder of a parking permit or an
access card may use the municipal parking facility specified on that parking
permit or access card without paying any fee as set out in Schedule “1”of
this by-law other than the permit or access card fee.
3.
A parking permit or access card is not
valid until the fee as set out in Schedule “1”of this by-law for the
issuing of a parking permit or access card is paid.
4.
The rights attached to a parking permit
or access card are exclusive to the applicant for the parking permit or access
card in question and no person properly in possession
of such parking permit or access card shall use or permit the same to be used
for any other vehicle other then the vehicle for which it was issued by the
director.
5.
The Director is authorized to issue
parking permits and access cards to the employees of the Corporation of the
City of Burlington. Such permits are to be for such times and on such terms as
are approved by the Director.
6.
The Director is further authorized to
revoke a parking permit or access card if the holder of that
parking permit or access card fails to ensure that the card is used in
the manner prescribed by this by-law and any fee paid
therefore shall be forfeited to the Municipality.
14. SIGNS AND MARKERS
1. The Director is authorized to install in or on any municipal
parking facility such
signs and markers or other devices as may be necessary for the safe and
efficient operation of such a municipal parking facility.
2. The Director shall cause the amount of the fee for parking
to be displayed in a
place in or on each municipal parking facility by means of a sign or signs.
15. PERMIT PARKING
2.
A person may obtain
from the Director, a municipal parking permit to park a vehicle in a
specified municipal parking facility for the current month or part thereof upon
payment of the prescribed fee as set out in Schedule “1” of this by‑law.
3.
No person shall park a vehicle in or on
any municipal parking facility named and as set out in Schedule “1” of this by‑law during the hours of operation as
set out in Schedule “1”of this
by-law unless the vehicle has a valid monthly permit clearly displayed.
16. PROHIBITIONS
No
person shall park a vehicle at any time on any municipal property:
1. Without consent of the Corporation of the City of
Burlington;
2. For the purpose of repairing or storing
a vehicle;
3. Unless
a fee is deposited in the parking machine or parking meter controlling that
parking space in accordance with the rates as set out in Schedule “1” of
this by-law;
4.
Where the time purchased at that parking
machine or parking meter has expired;
5. Exceeding
the posted time limit indicated on that parking meter as set out in Schedule
“1” of this by-law;
6. Without a valid parking machine receipt or parking permit
clearly displayed in the windshield and readable from the outside of the
vehicle;
7.
That is a large vehicle or detached
trailer;
8.
Outside the lines painted on the
pavement designating a parking space;
9.
During the prohibited times and dates as
set out in Schedule “1” of this by-law.
PART IV
PRIVATE PROPERTY
PARKING
17. PROPERTY OWNERSHIP
If it
is alleged in a proceeding that this section has been contravened, the oral or
written evidence of the Enforcement Officer is receivable in evidence as proof,
in the absence of evidence to the contrary, of the facts stated therein in
respect of:
1. The ownership or occupancy of the
property;
2. The absence of the consent of the
owner;
3. Whether
any person is an “owner” as defined in Part 1 of this by-law.
18. SIGNS
For the
purposes of this section, the owner of a private property shall post signs on
the private property used for parking a vehicle, stating the regulations on
which a vehicle may be parked
or
left on the private property.
19. PROHIBITIONS
No
person shall park a vehicle at any time on any private property:
1. Without the consent of the owner of the
property, or;
2. Without the consent of the public
authority or local board, where the property is owned by a public authority or
any local board, and;
3. Outside the lines painted on the
pavement designating a parking space.
PART V
20. DESIGNATION
Each private roadway, which is located on a property
as set out in Schedule “2” of this
by-law, is hereby designated as a fire route.
21. PROHIBITIONS
1.
No person shall
park a vehicle on or in a fire route at any time.
2.
No person, being the owner of private
property upon which a fire route is located shall fail to install or maintain
signs identifying the fire route and prohibiting parking upon the fire route in
the manner and form specified by the Fire Chief.
3.
No person, being the owner of a property
on which a fire route is located, shall fail to maintain a fire route in good
repair to allow safe passage of a fire truck.
4.
No person, being the owner of a property
on which a fire route is located shall fail to keep the fire route clear of
snow and ice.
5.
No person, being the owner of as
property on which a fire route is located, shall fail to keep the fire route
free and clear of obstructions.
PART VI
DISABLED PARKING
REGULATIONS
22. DISABLED PARKING SPACES
1.
Every owner or operator of a public
parking area shall provide disabled parking spaces for the exclusive use of
vehicles operated by or conveying physically disabled persons, upon which
vehicles shall be properly displayed a disabled
parking permit as provided for in this by-law.
2.
The minimum number of disabled parking
spaces, which must be provided, shall be calculated in accordance with the
Corporation of the City of Burlington Zoning by-law, as amended from time to
time.

(b) Where outpatient services are provided,
disabled parking shall be a minimum of 10% of required parking.
23. REQUIREMENTS FOR DISABLED PARKING SPACES
Every
owner or operator of a public parking area shall ensure that the disabled
parking spaces as required shall be:
1.
No less than 4.6 metres wide for a
single off-street parking space;
2.
No less than 7.7 metres wide for a
double off-street parking space;
3.
No less than 7.2 metres long for an
on-street parking space;
4.
Level on a hard surface;
5.
Located so as to be readily accessible
to physically disabled persons, whether via ramps, depressed curbs or other
means and where the public parking area is intended to serve a particular
building or complex, located within easy access of said building or complex;
6.
Identified by a sign located upright on
a permanent post, pillar, wall or other suitable surface, conforming to the
requirements of regulations made under the Highway Traffic Act.
24. RESPONSIBILITY OF MAINTAINING DISABLED PARKING SPACES
Every
owner or operator of a public parking area shall ensure that disabled parking
spaces as required, shall be:
1.
Kept free and clear from obstructions;
2.
Kept free and clear of snow, ice and
slush;
3.
Maintained to the same standards as all
other parking spaces in the same public parking area.
25. LOCATIONS
Disabled
parking spaces, for the purposes of this by-law section, shall mean the
designated parking spaces as set out in Schedule
“3” of this by-law and any such space as required by any site plan approved
by the Corporation of the City of Burlington.
26. SIGNS
1.
Disabled parking
signs referred to in this by-law shall comply with regulations made under the Highway Traffic Act.
2.
Disabled parking
signs shall be mounted on a permanent post and be located:
(a) At a
minimum height of one (1) metre from grade to the bottom of sign;
(b)
At a
maximum height of two (2) metres from grade to the bottom of the sign;
(c)
Midway
between the lateral limits of the disabled parking space, so as not to lock
vehicle or passenger access.
3. Every
owner or operator of each public parking area in which disabled parking signs
are located, pursuant to this by-law, shall be responsible for the procurement,
installation and maintenance of said disabled parking signs and for ensuring
that said disabled parking signs comply with regulations made under the Highway Traffic Act.
27. PROHIBITIONS
1. No person shall park a vehicle in a
disabled parking space unless a valid disabled parking permit is properly
displayed upon the vehicle ensuring that the permit number and expiry date are
clearly visible.
2. No person shall park a vehicle in a
manner that would obstruct the use of a disabled parking space.
PART VII
PARKING AND STOPPING ON A HIGHWAY
28. METHOD OF PARKING
1. General
All vehicles, when parking or stopping, shall only park or stop a
vehicle on the right side of the highway, having regard to the direction of the
normal flow of traffic and with the right front and right rear wheels parallel
to the curb line.
2. Parking on One-Way Streets
On a highway designated for one-way traffic, a vehicle shall only be
parked in the direction in which traffic is permitted to proceed and parallel
to the curb line.
3. Angle
Parking
Angle parking is permitted on any highway or
parts thereof where signs to that effect are on display, as set out in Schedule
“4” of this by-law.
29. LOADING ZONE RESTRICTIONS
1.
Loading
zones shall be in the locations as set out in Schedule “5” of this
by-law.
2. A
loading zone shall be indicated by signs installed by the Corporation of the
City of Burlington.
3. No
person shall stop or park a vehicle in a loading zone unless the vehicle that
is stopped or parked is actively engaged in the loading or unloading of
merchandise.
4. The
times and duration of the operation of the loading zones shall be as set out in
Schedule “5” of this bylaw.
30. EMERGENCY
PARKING OR STOPPING RESTRICTIONS
Restricted
Parking or Stopping
Notwithstanding
any other provisions of this by-law, the Chief of Police, Fire Chief, or the
Director during an emergency or special circumstance may:
1.
Prohibit any or all parking on a highway
within the area affected by an emergency or special circumstance;
2.
Authorize the erection of “No Parking”
or “No Stopping” signs, traffic control devices or traffic signals;
3.
Declare that any vehicle already parked
is parked illegally regardless of the time permitted for parking such vehicle
under the provisions of this by-law.
31. PARKING PROHIBITIONS
1. SIGNS NOT ON DISPLAY
Unless
specifically permitted by other provisions of this by-law, no person shall park
any vehicle at any time on any highway:
(a) Designated
for two-way traffic, except on the right side of the highway with the right
front and right rear wheels parallel with the curb line;
(b) Designated for one-way traffic, other
than in the direction in which traffic is permitted and parallel to the curb
line;
(c) As to obstruct any portion of a
sidewalk;
(d) On any portion of a boulevard;
(e) On or adjacent to a median strip or island;
(f) In front of or within one (1) metre of
any entrance to a driveway or laneway, so as to prevent egress or ingress;
(g) Within three (3) metres of a fire
hydrant;
(h) As to obstruct traffic;
(i) More than thirty (30) centimetres from
the curb line;
(j) Outside the lines painted on the pavement that designate a parking space;
(k) On a shoulder of a roadway;
(l) Exceeding three (3) hour limit unless
otherwise signed;
(m) That is a
large vehicle or detached trailer on any street in any residential area unless
it is at the time being used to make a delivery or to provide a service;
(n) Interfering
with snow removal.
2. SIGNS ON DISPLAY
No
person shall park any vehicle at any time on any highway:
(a)
On the days and times as set out in Schedule
“6”of this by-law;
(b)
On any portion thereof as set out in Schedule
“7” of this by-law;
(c)
Except on the days and times as set out
in Schedule “12” of this by-law;
32. STOPPING PROHIBITIONS
1. SIGNS NOT ON DISPLAY
Unless otherwise signed, no person shall
stop a vehicle at any time on any highway:
(a) As to obstruct any crosswalk;
(b) On either side of a highway that is
divided by a median strip;
(c) Within
fifteen (15) metres of either side of signed bus stop;
(d) On or within
one hundred (100) metres of a bridge that is over, under or across which the
highway passes;
(e) On or within three (3) metres of a
railway crossing.
2. SIGNS ON DISPLAY
Where
signs to that effect are on display, no person shall stop a vehicle at any time
on any highway:
(a) On
any portion thereof as set out in Schedule “8” of this by-law;
(b) On the days and times as set out in Schedule
“9” of this by-law;
(c) Abutting any school property, park or
playground except as set out in Schedule “10” of this by-law;
(d) In front of or within fifteen (15) metres
of either side of any fire hall on the same side of the highway as the fire
hall or within forty five (45) metres from a point in the curb or edge of
roadway directly opposite the centre point of the fire hall on the opposite
side of the highway from the fire hall;
(e) Within fifty (50) meters of an
intersection on a highway;
(f)
Within a school bus loading zone, except
school buses, as set out in Schedule “11” of this by-law.
33. HOURS OF OPERATION
Signs
shall be affixed to parking meters or adjacent to parking meter zones to
indicate days and hours of operation.
34. COLLECTION
The collection of the coins deposited in all
parking meters shall be the responsibility of the Corporation of the City of
Burlington.
35. PROHIBITIONS
1.
No person shall park any vehicle at a
parking meter:
(a)
Unless a fee is deposited in the parking
meter controlling that parking space in accordance with the parking rates as
set out in Schedule “13” of this by-law;
(b)
Where the time purchased at that parking
meter has expired;
(c)
Exceeding the posted time limit
indicated on that parking meter as set out in Schedule “13” of this
by-law;
(d) That is
covered by a parking meter bag prohibiting the use of that parking space.
36. RESERVED METER PARKING
Notwithstanding
any other provisions of this by-law, reserved meter parking shall be permitted:
1.
With the purchase of a permit issued by
the Corporation of the City of Burlington to park a vehicle at that parking
meter space, and;
2.
For a specific period of time at a rate
in the amount and manner as set out in Schedule “13” of this by-law.
37. EXEMPTIONS
1. Parking Without
Payment
The owner or operator of a vehicle may park at a
parking meter space or in an un-enclosed municipal parking facility without
having to pay the required standard parking fees, for the maximum time allowed,
for vehicles that clearly display:
(a) A
valid Ontario Disabled Parking Permit where the number and expiry date of that
permit is clearly visible;
(b) A Veteran
Parking Permit issued by the Corporation of the City of Burlington;
(c) Notwithstanding
sections 37.1(a) or 37.1(b), the owner of any vehicle who is exempt from the
payment of the required fee shall comply with all other Applicable regulations
of this by-law.
2. Neighbourhood On-Street Parking Program
Notwithstanding any
other provision of this by-law, parking on street shall be permitted through
the Neighbourhood On Street Parking Program (NOSPP) based on the
following:
(a) Rules and Regulations for parking in
NOSPP areas;
(b) Notwithstanding the NOSPP Rules and
Regulations pursuant to section 37.2(a), all other provisions of this by-law
shall apply;
(c) The NOSPP area shall be indicated by
signs as set out in Schedule “14” of this By-law.
3. On-Street
Parking Exemptions
Notwithstanding
any other provision of this by-law, an exemption from sections 31.1(l) of this
by-law may be granted based on the following:
|
(a) |
The
exemption shall apply to a specific vehicle licence plate, a specific street
and for a specific time period; |
|
|
|
|
(b) |
A
vehicle licence plate will be allowed a maximum total of fifteen (15)
individual days per calendar year; |
|
|
|
|
(c) |
Notwithstanding any exemption granted
pursuant to this subsection, all other provisions of this by-law shall apply. |
4. Large
Vehicle or Detached Trailer Exemption
School
buses and school handi-vans are exempt between 9:00 am and 3:00 pm, September 1st
to June 30th, Monday to Friday, except for statutory holidays and
school breaks as set out in section 31.1(m) of this by-law.
5. Essential
Service Exemption
The provisions of this by-law shall not apply to
Police, Fire and Ambulance vehicles and any vehicles while actually engaged in
works undertaken for or on behalf of the Corporation of the City of Burlington,
the Regional Municipality of Halton, the Province of
Ontario, the Federal Government of Canada or any utility providing service of
gas, hydro or telecommunications.
38. SHORT FORM WORDINGS AND SET FINES
1. Short form wordings and set fines pertaining
to this by-law shall be as set out in Schedule “15” of this by-law.
2. Any
person who contravenes any of the provisions of this by-law is guilty of an
offence and upon conviction is liable to a fine as provided for in the Provincial Offences Act, the Municipal Act 2001, or
the Fire Protection and Prevention
Act, as applicable and any
such successor to each of those statutes.
39. COMMENCEMENT
This by-law shall come into force and effect upon the date
of the issue of an Order by the Chief Judge of the Ontario Court of Justice or
his or her designate made for the purpose of proceedings under Part I and
Part II of the Provincial Offences Act.
REPEAL OF BY-LAWS
By-laws
61-1986 as amended, 71-1983 as amended, 130-1976 as amended, 101-1990 as
amended and 1984-1 as amended are repealed on the date this by-law takes
effect.
