CORPORATION OF THE CITY OF BURLINGTON

 

BY-LAW NUMBER 95-1989

 

A By-law to designate property known as the La Salle Park Pavilion located in La Salle Park, being Part lots 6 and 7 B.F. Concession, formerly in the Township of East Flamborough now in the City of Burlington, Regional Municipality of Halton, as property having historical and architectural value and interest pursuant to the Ontario Heritage Act

 

WHEREAS by Section 29(6)(a) of the Ontario Heritage Act, R.S.O. 1980, chapter 337, as amended, the Council of a Municipality shall pass a by-law designating property to be of historical and architectural value and interest where no Notice of Objection to the designation has been served on the City Clerk within thirty days after the date of first publication of the Notice of Intention to designate in a newspaper having general circulation in the Municipality;

 

AND WHEREAS Notice of Intention to designate the La Salle Park Pavilion located in La Salle Park was published in a local newspaper and served on the Owners of the property and on the Ontario Heritage Foundation by registered mail;

 

AND WHEREAS the reasons for the said designation are set out in Schedule "A" attached hereto and forming part of this by-law;

 

AND WHEREAS no Notice of Objection was served on the City Clerk of the City of Burlington.

 

NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF BURLINGTON HEREBY ENACTS AS FOLLOWS:

 

1.  THAT the La Salle Park Pavilion located in La Salle Park, more particularly described in Schedule "B" attached hereto and forming part of this by-law, be designated as being of architectural and historical value and interest.

 

2.  THAT the City Clerk be directed to cause a Notice of this by-law to be published in a local newspaper having general circulation in the Municipality.

 

3. THAT the City Clerk be directed to cause a certified true copy of this by-law to be served upon the Owners of the La Salle Park Pavilion and upon the Ontario Heritage Foundation.

 

4. THAT this By-law shall take effect on the date of its registration in the Land Registry Office for the Land Registry Division of Halton (No. 20)

SCHEDULE "A"

 

REASON FOR THE DESIGNATION

 

The Local Architectural Conservation Advisory Committee at its meeting held 1988 September 26 agreed that the La Salle Park Pavilion was worthy of designation.

 

The Pavilion, built on 1917 March 24, was a combination dancing pavilion and picnic area which is a rarity for Hamilton park structures.  Most structures, apart from the Gage Park Bandshell , usually serve as service buildings incorporating changing facilities, showers and lockers.

 

La Salle Park, formerly Wabasso Park was purchased for $52,673.00 in 1913 from Mr. P. W. Brown.

 

The site of La Salle Park is supposed to be the landing point for Sieur de La Salle, an early explorer.  A memorial stone commemorating this event was erected on 1922 July 17 and Wabasso Park was renamed La Salle Park in 1926.

 

In 1928, the management of the Park was turned over to Mr. Maurice L. Smith on a ten-year lease on which to operate an amusement park.

 

The main architectural features are its rectangular dimensions with a verandah set between two arcaded pavilions (one open and one which was formerly glazed and is now closed) which are decorated with pilasters.  The central dormer has a mansard roof and formerly had five bays with three six-paned casement windows in each bay (these windows are no longer in place but have been bricked over).

 

L.A.C.A.C. feels that this building is worthy of designation and once designated, the building becomes eligible for heritage funding.

 

 

SCHEDULE "B"

 

FIRSTLY, Part lots 6 and 7 Broken Front Concession formerly in the Township of East Flamborough now in the City of Burlington, Regional Municipality of Halton:

 

COMMENCING at a point in the northeasterly limit of said lot 6 distant seventeen hundred two and six-tenths feet (1702.6') measured south forty-five degrees east (S45°E) along its northeastern limit from its northern angle.

 

Thence south forty-nine degrees and five minutes west (S49°5' W) sixteen hundred fifty-nine and eight-tenths feet (1659.8').

 

Thence south forty-two degrees and twenty-six minutes east (S42°26' E) one hundred thirty-one and one-tenth feet (131.1').

 

Thence south twenty-nine degrees and six minutes east (S29°6' E) one hundred thirty-five and one-half feet (135.5').

 

Thence south thirteen degrees and thirty minutes east (S13°30' E) three hundred and thirty feet (330').

 

Thence south four degrees and thirty minutes west (S4°30' W) one hundred fifty-three and one-half feet (153.5').

 

Thence south eleven degrees and thirty-nine minutes east (S11°39' E) forty-four and one-half feet (44.5').

 

Thence south twenty-nine degrees and thirteen minutes east (S29°13' E) forty-six and one-half feet (46.5').

 

Thence south forty degrees and seventeen minutes east (S40°17' E) seventy and one-half feet (70.5').

 

Thence south forty-four degrees and twenty-three minutes east (S44°23' E) three hundred fifteen and one-half feet (315.5') more or less to the high water mark of the waters of Burlington Bay.

 

Thence easterly along said high water mark twenty-one hundred eighty feet (2180') more or less to the easterly angle of said lot 6.

 

Thence north forty-five degrees west (N45°W) fifteen hundred eighty-two and four-tenths feet (1582.4') more or less along the north westerly limit of said lot 6 to the place of beginning.

 

The above described parcel of land containing by admeasurement fifty-five acres (55 Ac.) be the same more or less.

 

SECONDLY, All that parcel of land formerly in the Township of East Flamborough in the County of Wentworth now in the City of Burlington, Regional Municipality of Halton, being water lot in the front of the northeasterly part of lot number 7 in the Broken Front Concession according to a plan of survey by Provincial Land Surveyor Thomas Allen Blyth dated 14th April 1862 of record in Crown Lands Department, that is to say:

 

COMMENCING at the waters edge of Burlington Bay at the easterly angle of said lot number 7 in the Broken Front Concession, thence southwesterly following the said waters edge four hundred seventy-nine and sixteen one-hundredths feet (479.16') more or less to the southerly angle of the land belonging to the said Alexander Brown in the said lot 7.

 

Thence south forty-five degrees east (S45°E) four hundred sixty-two feet (462').

 

Thence north forty-five degrees east (N45°E) four hundred seventy-nine and sixteen one-hundredths feet (479.16') more or less to the northeastern limit of the said lot 7 produced.

 

Thence north forty-five degrees west (N45°W) four hundred sixty-two feet (462') more or less to the place of beginning, containing four and one-half acres (4.5 Ac.).

 

Reserving nevertheless within the limit of the above described water lot all that portion thereof lying in front of the road laid out to Burlington Bay which said road as shown on the plan of survey above mentioned is one chain wide.  Said parcel being shown on the plan hereto annexed to Instrument 9042 E.F.
