The Molinaro Group has made an application to amend the Official Plan designation and Zoning for the lands located at 774, 778, 780 and 782 Brant St. (Parcel ‘A’); 769, 779, 783 Brant St. and 2023, 2027, 2031-2033 Ghent Ave. (Parcel ‘B’); and, 747 and 761 Brant St. (Parcel ‘C’) (Ward 2). The File Reference Nos. are 505-06/21 & 520-07/21.

The application proposes the redesignation and rezoning of the total landholding to facilitate a multi-phase, mixed use development with a 25-storey tower and a 14-storey tower (with ground floor commercial area) including 425 residential units (Parcel A); a 25-storey tower (with ground floor commercial area) including 328 residential units (Parcel B); and, 8-storey mid-rise building with 128 residential units (Parcel C).

Notice of Addendum and Public Open House  The Study 

The City of Burlington has partnered with Branthaven Homes, represented by R.J. Burnside & Associates Limited, to update the Municipal Class Environmental Assessment (MCEA) for the Appleby Creek Flood Mitigation project between Fairview Street and New Street. Since the original study was completed in 2019, changes in land use and proposed developments near the Fairview Street crossing have necessitated a review.  

Area Map The Process 

The Addendum to the 2019 Project File Report is being completed in accordance with the requirements of the MCEA process (Municipal Engineers Association, February 2024) which is an approved process under the Ontario Environmental Assessment Act. The Addendum contains the background and technical analysis of the revised hydraulic crossing of Fairview Street. The City is seeking comments on the proposed changes as outlined in the Addendum.

NOTICE OF PASSING OF A MUNICIPAL-WIDE DEVELOPMENT CHARGES BYLAW BY THE CORPORATION OF THE CITY OF BURLINGTON

Development Charges Background Study and Bylaw

On May 21, 2024, City of Burlington Council passed Development Charges By-law 41-2024, which applies to all lands in the City of Burlington, under section 2(1) of the Development Charges Act, 1997, S.O. 1997, c.27, as amended. This establishes development charges for the City of Burlington and repeals By-law 29-2019, as amended by 26-2022.

By-law 41-2024 is effective as of June 1, 2024 and imposes uniform residential and non-residential development charges upon all lands within the boundaries of the City of Burlington as shown on the map. The schedule of development charges imposed by the bylaw is shown in Schedule A.

Development charges are levied against new developments and are a primary source of funding for development-related capital expenditures.

A decision was made on the date noted above to approve Amendment No. 132 to the Official Plan of the City of Burlington. Purpose and effect of the Amendment The purpose of this Amendment is to redesignate the lands at 276, 284 and 292 Plains Rd East from “Residential” – Medium Density” to a site specific “Mixed Use Corridor – General” to permit a seven-storey residential apartment building on the subject lands.
Public consultation was conducted between Dec. 22, 2021, and May 6, 2024. As a result of public consultation, the City received thirteen comments and four delegations at the Statutory Public meeting held on Feb. 1, 2022 and two delegations at the Committee of the Whole meeting held on May 13, 2024. Notice of Passing of Zoning Bylaw 2020.476

Burlington City Council passed Bylaw 2020.476 to amend Bylaw 2020, as amended, on May 21, 2024, under Section 34 of the Planning Act, 1990, as amended. File number: 520-08/21 (PL-36-24).
Bylaw 2020.476 rezones land at 276, 284 and 292 Plains Rd East to permit a seven-storey residential building, including mechanical penthouse.
Public consultation on the proposed zoning bylaw amendment occurred through a Statutory Public Meeting held on Feb. 1, 2022, at the Community Planning, Regulation and Mobility Committee. Notice of the Statutory Public Meeting was mailed to tenants and owners within 120m of the subject land on Dec. 22, 2021, and published in the Hamilton Spectator on Jan. 6, 2022. The City received thirteen comments on the proposed amendment. There were four delegations at the Statutory Public Meeting on Feb. 1, 2022 and two delegations at the Committee of the Whole meeting on May 13,
2024.
