The City’s Public Notice Policy ensures the community knows how and when notices will be provided and aligns with the principles of open government.

Notice of decision for Official Plan Amendment 155

Subsection 17(34) of the Planning Act 

Date of decision: Dec. 10, 2024
Date of notice: Dec. 19, 2024
Last date of appeal: Jan. 8, 2025 

A decision was made on the date noted above to approve Amendment No. 155 to the Official Plan of the City of Burlington. 

Purpose and Effect of the Amendment

The purpose of this Amendment is to add a site specific policy to the lands located at 291 North Service Rd. 

Public consultation was conducted between Sept. 11, 2024 and Dec. 3, 2024. As a result of public consultation, the City received two comments and one delegation at the Statutory Public meeting held on Dec. 3, 2024. Comments received were considered as part of Council’s decision-making process. 

When and How to File an Appeal

Any appeal to the Ontario Land Tribunal must be filed with the City of Burlington, c/o the City Clerk, 20 days from the date of this notice, as shown above as the last date of appeal.

A decision was made on the date noted above to approve Amendment No. 154 to the Official Plan of the City of Burlington. 

Purpose and Effect of the Amendment

The purpose of this Amendment is to modify the “Mixed Use General” designation at 141, 147 and 153 Plains Rd West. 

Public consultation was conducted between Sept. 18, 2024 and Dec. 3, 2024. As a result of public consultation, the City received nine comments and two delegations at the Statutory Public meeting held on Dec. 3, 2024. Comments received were considered as part of Council’s decision-making process.

Notice of Passing of a Municipal-Wide Community Benefits Charge Bylaw

Community Benefits Charge Strategy Update and Bylaw

On Dec. 10, 2024, Burlington City Council passed Community Benefits Charge Bylaw 81-2024, which applies to all lands in the City of Burlington, under section 37 of the Planning Act, R.S.O. 1990, Chapter P.13, as amended. Bylaw 81-2024 establishes community benefits charges for the City of Burlington and repeals Bylaw 66-2022.   

Bylaw 81-2024 is effective as of Jan. 1, 2025, and imposes community benefits charges on residential high-density developments and redevelopments upon all lands within the boundaries of the City of Burlington as shown on the map

Community benefits charges are levied at the prescribed rate of 4% of land value against high-density development or redevelopment of buildings with five or more storeys and 10 or more residential units for development-related capital expenditures.

Procedure Bylaw amendment

In accordance with the Public Notice Policy, The Corporation of the City of Burlington hereby gives notice of its intention to amend Bylaw No. 59-2024, Council’s Procedure Bylaw, to replace section 46.1 to clarify that delegations are due by noon, one business day before a meeting:

46.1 Requests to delegate at a committee meeting and Council must be submitted to the Clerks department prior to 12 p.m., one business day before a meeting to which the delegation relates.   

This matter will be considered at the Committee of the Whole on Monday, Dec. 2, 2024 at 9:30 a.m. in Council Chambers, City Hall, 426 Brant St, Burlington, with members, staff and delegates participating in-person or remotely via Zoom. If approved, the matter will be forwarded to City Council on Dec. 10, 2024.
