Outdoor Winter Play Challenge (the “Contest”) Contest Rules and Privacy Statement

NO PURCHASE IS NECESSARY TO PLAY OR WIN

SEE BELOW FOR FULL CONTEST DETAILS. PARTICIPATION IN THIS CONTEST CONSTITUTES YOUR FULL AND UNCONDITIONAL ACCEPTANCE OF, AND AGREEMENT TO BE LEGALLY BOUND BY, THESE CONTEST RULES (the “CONTEST RULES”).

1. Contest Period:

  • Wednesday February 1, 2023, at 8 a.m. and ends on Tuesday February 28, 2023 at midnight.

2. How to Play:

  • Download the Goosechase app
  • Register your household as a user
  • Search for and join the challenge by name or game code MQVX7J
  • Begin completing missions

By registering for this contest, you agree to abide by the contest rules and understand that the information you provide will be governed by our privacy statement for this contest.

*Please note that GooseChase has separate terms of use that you should review before downloading the app.

3. Eligibility:

Contest is open to all residents of the City of Burlington, Ontario, Canada, except for employees and elected officials of The Corporation of the City of Burlington (the “City”), and parents, siblings, children or those domiciled with an employee or elected official of the City.

Goosechase submission photos must have at least one individual of the household participating in the Contest in the picture when completing an activity. Individual participants may take selfies or get other people to take a picture of them participating in the challenge.

4. How to Enter and Winner Selection:

To be eligible for the prizes, entrants must complete and record activities on the Goosechase app (game code #MQVX7J). The entrants with the highest points accumulated and have submissions that meet the required submission guidelines at the close of the Contest Period will win. In the event of a tie, the City will conduct a draw amongst the entrants with the most points. There will be only one (1) winner selected for each prize.

The City will award the winners from among all eligible entries received during the Contest Period.

The prize awards will be conducted the week of March 6, 2023.

Each selected entrant will be contacted via a message on Goosechase. If the selected entrant does not respond within three (3) calendar days of being notified, then that selected entrant will be disqualified, and the City will choose the next winner with the highest score. All winners who respond and agree to claim their prize, shall have a maximum of thirty (30) days from the date of notification, to pick up their prize, otherwise the prize will be forfeited.

If a selected entrant is a minor (e.g. under the age of 18), then the prize will be awarded in the name of his/her parent or legal guardian who will be responsible for fulfilling all of the requirements of this contest or another entrant may be selected for the prize at the City’s discretion.

In order to be declared a prize winner, the selected entrant must correctly answer a time-limited mathematical skill testing question without any assistance when claiming the prize and must sign a Prize Claim Form.

There will be a total of one winning household for each Prize

First Prize: One - Year Family Membership to RBG & $200 SAIL Gift Card

Second Prize: Year Family Membership to RBG & $100 Sport Chek Gift Card

Third Prize: $100 Sport Chek Gift Card      

Prizes must be accepted as awarded and are not transferable. The City may substitute any prize of equal or greater value if the original prize cannot be awarded.

Each entrant who participates in the Contest fully and unconditionally agrees to comply with and abide by these Contest Rules.

The decisions of the City are final and binding in all respects relating to the contest and may not be challenged in any way.

The City may require proof of identity and/or eligibility to participate in the contest or to claim a prize. Failure to provide such proof may result in disqualification.

5. Odds of Winning:

Odds of winning depend on the number of eligible entries received for the Contest.

6. Winners List:

A list of winners will be available on the website at burlington.ca/playoutside.

7. General Rules:

This contest is administered by the City through the Recreation, Community and Culture Department.

By participating in this contest, the selected entrants agree to sign a Prize Claim Form which releases the City from any liability in connection with this contest or the prizes awarded.

By entering this contest, entrants indicate their consent to their personal information being stored, used and processed by the City for the purposes of administering this contest and for promotional and marketing purposes. The declared prize winners' information, including his/her name, mailing address, telephone number and/or email address, may be shared with the City’s contest administrator (as required) to award the prizes of this contest.

Entrants waive their copyright and moral rights and any other intellectual property right associated with the pictures submitted as part of this contest and the City shall have the right to use the entrant’s photo submission for any purpose, without compensation to the entrant.

The terms and conditions of this contest are governed by and construed in accordance with the laws of the Province of Ontario, Canada and the federal laws of Canada applicable therein. Any dispute arising hereunder will be adjudicated solely in the Province of Ontario, Canada.

This contest is void where prohibited.

The City reserves the right to modify, amend, suspend or terminate this contest, without prior notice, obligation or liability to anyone.

The City may cancel or suspend this contest should fraud, virus, bugs or other causes corrupt the administration, security or proper play of the contest.

With respect to computer entries, the City is not responsible for the computer system, phone line, hardware, software or program malfunctions or other errors, failures or delays in computer transmissions or network connections that are human or technical in nature.

Any attempt to deliberately undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made, the City reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

Photo submission must be authentic and original. No replication of photos from other material printed or electronic is allowed. Photo must have at least one (1) member of the group actively participating in the challenge. The City reserves the right to disqualify any individual or group (an all of his or her contest entries) who tampers or attempts to tamper with the entry process or submits photos that are not original or authentic.

The City and its employees, elected officials, agents, and assigns will not be responsible for any costs, losses, damages or expenses arising by reason of accident, negligence, printing, administrative or other errors that may arise or occur in connection with this contest.

Privacy Statement as it applies to Recreation, Community and Culture Outdoor Winter Play Challenge

The Corporation of the City of Burlington (“City”) recognizes our responsibility to protect the personal information provided to us. In brief, "personal information" is information that can be uniquely identified with you, such as your full name, address, email address and phone number for the purposes of the Outdoor Winter Play Challenge.

This privacy statement applies to individuals who deal with us in relation to the contest and to all personal information that we collect about you for the purposes of the contest. The City does not control the content or the privacy policies of third-party online resources, such as GooseChase, and this privacy statement does not apply to such resources.

By entering the contest, you agree with the terms of this privacy statement and you consent to the collection, use, and disclosure of personal information in accordance with this privacy statement.

1. ACCOUNTABILITY

Personal information is collected under the authority of the Municipal Act, 2001, S.O. 2001, c. 25 and will be used to forward communication for the purpose of awarding the prizes and for the purposes as set out in the contest rules. 2. IDENTIFYING PURPOSES

The City is collecting personal information in this instance for your entry into the contest and for the purposes as set out in the contest rules.

3. CONSENT

Your knowledge and consent are required for the collection, use or disclosure of personal information about you.

4. LIMITING COLLECTION

The City will limit the collection and use of both the amount and the type of personal information to that which is necessary for the identified purposes, for the management and oversight of the data collection, to ensure compliance with this privacy statement as it applies to the contest, to preserve the integrity of the contest database or to comply with applicable laws and/or regulations.

4. LIMITING USE, DISCLOSURE, AND RETENTION

  • Limiting Use: The City uses personal information about you only for the purposes for which it was collected.
  • Limiting Disclosure: The City does not disclose your personal information other than as described in this privacy statement or otherwise with your consent, unless permitted or required by law.
  • Limiting Retention: Personal information will be retained only as long as necessary to fulfill the purposes for which it was collected or in accordance with applicable laws and the City’s retention policies.

5. SAFEGUARDS

The City will take reasonable steps to ensure that personal information about you is protected from unauthorized access, disclosure, copying, use or modification. Although we have enacted certain security measures, we cannot guarantee the security of any information that you submit via email or over the internet. Please be aware that there are technology implications concerning the collection of information when you are visiting websites, including the City’s websites. Submission of personal information using such networks is done at your own risk since no internet transmission is ever 100 per cent secure or error-free. Our websites may contain links or references to other websites to which this privacy statement does not apply. The City is not responsible for the data collection and use practices of other organizations to which the City’s websites may provide links.
