Burlington City Council passed Bylaw 2020.452 to amend Bylaw 2020, as amended, on March 21, 2023, under Section 34 of the Planning Act, 1990, as amended. File number: 520-03/19 & 505-02/19 (PL-12-23)
Bylaw 2020.452 rezones lands at 441 Maple Ave., to permit a 12-storey residential building, including mechanical penthouse.
Public consultation on the proposed zoning bylaw amendment occurred through a Statutory Public Meeting held on May 14, 2019 at the Community Planning, Regulation and Mobility Committee of Council. Notice of the Statutory Public Meeting was mailed to tenants and owners within 120m of the subject land in April 2019. The City received 12 comments on the proposed amendment and there were three delegations at the Statutory Public Meeting held on May 14, 2019 and two delegations at the Community Planning, Regulation and Mobility Committee meeting held on Feb. 28, 2023.

Should you wish to appeal this bylaw to the Ontario Land Tribunal, you must file an appeal to the City Clerk by April 12, 2023. Your appeal must include your objection to the bylaw and the reasons for this objection along with a cheque for $1,100, payable to the Minister of Finance. Additional information on the Ontario Land Tribunal process can be located at www.olt.gov.on.ca.

Only individuals, corporations and public bodies may appeal a zoning bylaw to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or group on its behalf.
No person or public body shall be added as a party to the hearing of the appeal unless, before the plan was adopted, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
