Burlington City Council passed Bylaw 2020.454 to amend Bylaw 2020, as amended, on March 21, 2023, under Section 34 of the Planning Act, 1990, as amended. File number: 520-03/22 and 505-02/22 (PL-13-23)
Bylaw 2020.454 rezones lands at 4103 Palladium Way, to permit a five (5) storey long- term care facility building and a six (6) storey retirement home building with associated ancillary uses with access to Palladium Way.
Public consultation on the proposed zoning bylaw amendment occurred through a Statutory Public Meeting held on Sept. 13, 2022, at the Community Planning, Regulation and Mobility Committee of Council. Notice of the Statutory Public Meeting was mailed to tenants and owners within 120m of the subject land on Aug. 24, 2022, and published in the Burlington Post on Aug. 18, 2022. The City received no comments on the proposed amendment and there was one delegation at the Statutory Public Meeting held on Sept. 13, 2022, and there were no comments and one delegation at the Community Planning, Regulation and Mobility Committee meeting held on March 20, 2023.

Should you wish to appeal this bylaw to the Ontario Land Tribunal, you must file an appeal to the City Clerk by April 12, 2023. Your appeal must include your objection to the bylaw and the reasons for this objection along with a cheque for $1,100, payable to the Minister of Finance. Only individuals, corporations and public bodies may appeal a zoning bylaw to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or group on its behalf.
No person or public body shall be added as a party to the hearing of the appeal unless, before the plan was adopted, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
