Burlington City Council passed Bylaw 2020.479 to amend Bylaw 2020, as amended, on July 16, 2024, under Section 34 of the Planning Act, 1990, as amended. File number: 520-03/24 (PL-51-24)
Bylaw 2020.479 rezones land at 2071 Fairview St. to permit a reduction in the minimum required office space for the two (2) 18-storey towers. Public Consultation on the proposed zoning bylaw amendment occurred through a Statutory Public Meeting held on July 9, 2024, at the Committee of the Whole. Notice of the Statutory Public Meeting was mailed to tenants and owners within 120m of the subject land on June 7, 2024, and published in the Hamilton Spectator on June 7, 2024. The City received two comments on the proposed amendment. There was one delegation at the Statutory Public Meeting on July 9, 2024.

Should you wish to appeal this bylaw to the Ontario Land Tribunal, you must file an appeal to the City Clerk by Aug. 7, 2024. Your appeal must include your objection to the bylaw and the reasons for this objection along with a cheque for $1,100, payable to the Minister of Finance. Only the applicant, specified person and public bodies as defined in the Planning Act, and registered owners of lands to which the bylaw will apply and who made submissions at this public meeting or who have made written submissions to the City before the bylaw is passed, will be able to appeal the decision of the City of Burlington to the Ontario Land Tribunal.
No person or public body shall be added as a party to the hearing of the appeal unless, before the plan was adopted, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the
opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
