KFA Architects and Planners Inc. has made applications on behalf of the landowner 2816544 Ontario Inc. to amend the Official Plan and Zoning Bylaw for the lands located at 35 Plains Rd. E. The File Reference Numbers are 520-06/25 and 505-05/25.
Description of Proposed Development
The application proposes to amend the Official Plan and Zoning Bylaw to facilitate the development of a 13-storey mixed use building consisting of 161 residential units and approximately 457m2 of ground floor retail space. The proposal includes approximately 1,656m2 of amenity space in the form of balconies, roof top terrace and indoor roof amenity space. Vehicular access is proposed from Cooke Boulevard with two levels of underground parking including a total of 110 vehicle residential spaces and 6 vehicle visitor spaces.

Description of the Proposed Amendment
The City of Burlington Official Plan (1997), as amended, designates the subject property as ‘Mixed Use Corridor – Commercial Corridor’ which permits a range of retail, service commercial and personal service uses; as well as medium and high-density residentials. Site-specific OPA 105 further permits a 9-storey mixed use building with a Floor Area Ratio (FAR) of 4.4:1. The application proposes to amend the Official Plan (1997) to “Mixed Use Corridor-Commercial” designation to permit a 13-storey mixed use building containing 161 residential units with a maximum Floor Area Ratio (FAR) of 6.9:1
The City’s new Official Plan (2020, subject to appeals) designates the property ‘Urban Corridor’ and is located within the Aldershot MTSA Area. Within the Aldershot GO MTSA, the subject site is located within the Aldershot Main Street Precinct which is intended to contain a mix of uses.
The site is zoned as MXC-470 (‘Mixed Use Corridor Commercial’ with site specific exception 470) which may permit a broad range of retail and service commercial uses and residential uses. Site exception 470 permits a 9-storey mixed use building with 72 residential units. The application proposes to amend the Zoning Bylaw site-specific exception (H-MXC-470) to permit a 13-storey mixed use building, increase of residential units, reduced setbacks, increased Floor Area Ration (FAR) of 6.9:1 among other proposed regulations by staff including a holding provision to address staff comments.
