Back to SearchThe City of Burlington is proposing amendments the Burlington Official Plan, 2020 that will delegate authority to staff to pass minor bylaw amendments under Section 34 of the Planning Act that are of a minor nature, in accordance with Section 39.2 of the Planning Act and the City’s Delegated Authority Bylaw, as outlined below. The proposed amendment will also establish alternative measures to be used for public notice and obtaining public opinion on Official Plan and Zoning Bylaw amendments.
Proposed Amendments
The proposed Official Plan Amendment will apply City-wide and will outline the objectives and policies for delegated authority. Delegated authority will allow staff the authority make technical changes to the Official Plan and to pass minor bylaw amendments under Section 34 of the Planning Act that are of a minor nature, in accordance with Section 39.2 of the Planning Act and the City’s Delegated Authority Bylaw. The proposed delegation of authority to pass minor bylaw amendments will be limited to:
- Lifting a Holding “H” Zone;
- A bylaw to authorize the temporary use of land, buildings or structures in a defined area Bylaw;
- Housekeeping amendments to ensure accuracy and clarity, and to assist with consistent interpretation and application of the Zoning Bylaw;
- Technical changes required to ensure accuracy and clarity and to assist in consistent interpretation and application of the Zoning Bylaw; and
- Bylaw to permit amendments to a zoning regulation (not including the permission for land uses otherwise not permitted or changes in zoning designation) where no objections were received during the commenting period and that the proposed bylaw amendments are consistent with the applicable policies of the Official Plan.
The proposed amendment will also establish alternative measures to be used for public notice and obtaining public opinion on Official Plan and Zoning Bylaw amendments, including:
- No longer requiring Notice of an Official Plan and Zoning Bylaw Amendment to be published in a newspaper, unless otherwise required by the Planning Act; and
- Using alternative measures to gather public opinion for minor bylaw amendments noted above.

The proposed Official Plan amendment and recommendation report will be available for public review on Friday. May 30, 2025. The report will be available on the City’s website at burlington.ca/calendar by searching for the June 10, 2025 meeting of the Committee of the Whole.
