These applications were approved by the Planning and Development Committee on Sept. 26, 2017. This approval was conditional on the applicant entering into a Residential Development Agreement and Community Benefits agreement with the city.
On Nov. 13, 2017, the applicant appealed their applications to the Ontario Municipal Board (OMB), now known as the Local Planning Appeal Tribunal (LPAT). The appeals were made on the basis that Council had not made a final decision on the applications within the provincially prescribed time limit.
After filing the appeals, the applicant continued to work with the city and entered into both the Residential Development Agreement and Community Benefits Agreement. The community benefits to be provided to the city by the developer are: $225,000.00 to be placed in a specific reserve fund for the provision of public art, street furnishings and landscaping on Plains Road East in the vicinity of 35 Plains Rd East.
On July 12, 2018, the Local Planning Appeal Tribunal (LPAT) approved the Official Plan amendment and Zoning Bylaw amendment that the applicant had requested.
