Brookfield Properties, InterRent REIT and CLV Group Inc. – 2269, 2243 Fairview Street and 864 Drury Lane – Ward 2 At their meeting of March 22, 2021, Burlington City Council approved the recommendation of Confidential Legal Report L-13-22 to accept an offer to settle the appeals of Brookfield Properties, InterRent REIT and CLV Group Inc. to the Ontario Land Tribunal based on the planning overview set out in Appendix ‘B’ to L-13-22. Council approved the recommendation that Appendix ‘B’ to L-13-22 be released publicly and posted on the City’s webpage under Planning and Development Applications for Ward 2, while retaining solicitor/client privilege over the balance of this matter in its entirety. The settlement proposal is for the site plan approval of two towers of 37 and 33 stories in height consisting of 774 rental residential units, as well as a second phase of development that will contain two towers of 35 and 33 stories in height consisting of 752 rental residential units in a future application for site plan approval. A copy of the planning overview (Appendix B to confidential Legal report L-13-22) is available on the development application web page. The settlement between the City and Brookfield Properties, InterRent REIT and CLV Group Inc.. resolves the issues in dispute between the City and Brookfield Properties, InterRent REIT and CLV Group Inc. on the basis that they will seek OLT approval of a revised site plan approval and zoning amendment for the subject lands.
