Permitted Uses

a) Only the following uses shall be permitted:

  1. Apartment Building
  2. Street Townhouses
  3. Back-to-Back Townhouses
  4. Townhouses
  5. Only the following non-residential uses on the ground floor of an apartment building are permitted:
  1. Convenience/Specialty Food Store
  2. Other retail stores
  3. Convenience Restaurant
  4. Other Service Commercial Uses
  5. Fast Food Restaurant
  6. Community Institution
  7. Standard Restaurant
  8. Veterinary Service, the keeping of animals outside is not permitted
  9. Banks, Trust Company, Credit Unions

Regulations for the Entire Site

a) Landscape Area and Buffer:

  1. Abutting the hypotenuse of a daylight triangle: 0 m
  2. Abutting Appleby Line: 5.5 m
  3. Abutting Thomas Alton Boulevard: 5.5 m
  4. Abutting Valera Road: 4 m
  5. Landscape Buffers are not required
  6. Hydro transformers, 1.5 m walkways, and underground parking exhaust grill shall be permitted within a required Landscaped Area.

b) Setbacks for an underground parking structure less than 1.6 m above grade:

  1. From Appleby Line: 3 m
  2. All other lot lines: 0.5 m

Regulations for Apartment Buildings

  1. Retail, Service Commercial and Community Institution Floor area: 197 m2
  2. Maximum number of apartment units: 344
  3. Amenity area: 25 m2 /unit
  4. Required Yards
  1. to the hypotenuse of a daylight triangle: 2.8 m
  2. to Appleby Line: 8 m
  3. to Thomas Alton Boulevard: 7 m
  4. to a Hydro Corridor: 8 m
  5. to Valera Road for storeys 1 to 3: 6.5 m
    1. 4th storey: 12 m
    2. 5th storey: 18 m
    3. storeys 6 to 8: 24 m
    4. 9th storey and above: 27 m
  1. e. Required separation from a townhouse or back-to-back townhouse building: 24 m
  2. f. Maximum Balcony projection from the wall of a building: 2 m
  3. Parking Spaces and Driveways:
    i. Driveways shall be setback 3 m from a window of a habitable room in dwelling units
  4. located on the ground floor or basement

h. Required Parking:

  1. 1 bedroom unit: 1 space / unit
  2. 2 bedroom unit: 1.25 space / unit
  3. 3 bedroom unit: 1.5 space / unit
  4. Visitor: 0.21 space / unit
  5. Loading: 2 spaces
  6. Commercial uses: 3.5 spaces / 100 m2 gross floor area
  7. Where a development is comprised of a mix of residential and non-residential uses, non-residential parking located on the same property as the residential use may be counted toward required visitor parking for the residential use.

  1. Maximum number of street townhouse units: 14
  2. Lot Width: 4.8 m
  3. Lot Area: 120 m
  4. Required Yards
    1. Front Yard: 6.6 m
    2. Side Yard abutting a RAL4 zone: 3 m
    3. Side Yard abutting a private road: 2.3 m
    4. Rear Yard for Block 2 Unit 14: 4.2 m
    5. Rear Yard for Block 2 Unit 13: 5.3 m
    6. Rear Yard for all other units: 6 m
  5. Privacy Area: 20 m2 per unit
  6. Required Parking:
    1. Visitor 0.25 spaces / unit
    2. Notwithstanding Part 1, Section 2.25.1, to provide the required off street visitor parking on the adjacent site to the north municipally know as 4916 Thomas Alton Boulevard
  7. Balconies:
    1. Balconies may project a maximum of 1.5 m into a required yard

    1. Side Yard
    1. West: 1.7 m

      1. From a lot line to the rear of a townhouse building: 6 m
    3. Required Visitor Parking: 0.25 spaces / unit
    4. Parking Spaces and Driveways:
      Driveways and parking lots shall be set back 2.5 m from a wall of a building containing
      windows of habitable rooms, except where a parking space and driveway is for the
      exclusive use of the unit occupant, the set back shall not apply.
    5. Balconies:
      1. Balconies may project 1.5 m from the rear wall of a townhouse building.

Regulations for Back to Back Townhouses

  1. Maximum Number of back to back townhouse units: 26
  2. Amenity Area”20 m2 per unit
    1. Each unit in a back to back townhouse development shall contain an individual balcony
      with an area of 4.8 m2, separated from adjoining units by a wall or privacy screen and
      with a maximum projection of 2.4 m from the front wall of the back to back townhouse
      building.
  3. Maximum Building Height: 3 storeys to 11.5 m
  4. Required Yards:
    1. To a street townhouse lot:10 m
    2. All other lot lines:30 m
  5. Parking Spaces and Driveways
    1. Driveways and parking lots shall be set back 1.8 m from a wall of a building containing
      windows of habitable rooms, except where a parking space and driveway is for the
      exclusive use of the unit occupant, the set back shall not apply.
  6. Required Visitor Parking: 0.25 spaces / unit

Except as amended herein, all other provisions of this By-law, as amended, shall apply.
