Burlington City Council passed Bylaw 09-2026, a bylaw to repeal Zoning Bylaw 2020, as amended, and replace it with a new Residential Zoning Bylaw only as it applies to certain residentially zoned lands, on March 2, 2026 under Section 34 of the Planning Act, 1990, as amended. (DGM-05-26)
Public consultation on the proposed new zoning bylaw occurred through Statutory Public Meetings held on Oct. 7, 2025 and Feb. 10, 2026 at the Committee of the Whole. Notice of the Statutory Public Meetings were published on the City’s webpage on Aug. 28, 2025 and Jan. 19, 2026, respectively. The City received 78 comments on the bylaw and there were five delegations at the Statutory Public Meeting held on Oct. 7, 2025 and seven delegations at the Statutory Public Meeting held on Feb. 10, 2026, and no delegations at the Special Council meeting held on March 2, 2026.

Only the Minister, the applicant, specified person and public bodies as defined in the Planning Act, and registered owners of lands to which the bylaw will apply and who made submissions at a public meeting or who have made written submissions to the City before the bylaw is passed, will be able to appeal the decision of the City of Burlington to the Ontario Land Tribunal.
No person or public body shall be added as a party to the hearing of the appeal unless, before the bylaw was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
