Appeals Committee

The Appeals Committee hears appeals from decisions issued by the City related to licensing bylaws. It also hear appeals against orders issued by the City under the City’s Property Standards Bylaw.

Make an Appeal

If you have been served an Order or Notice, you may wish to appeal. The Appeal Committee is a quasi-judicial body appointed by City Council. This means it has the authority to make decisions on claims or disputes.

The Appeal Committees role is to:

Hear appeals against decisions issued by the City under the City’s Licensing Bylaws. These include decisions to refuse, revoke, suspend, or add terms and conditions to a business license. The Appeals Committee will decide whether to uphold the decision and/or apply conditions; and
Hear appeals against orders issued by the City under the City’s Property Standards By-law 028-2009, as amended and under subsection 15.2(2) of the Building Code Act. The Appeals Committee will decide whether to confirm, modify or rescind an order to demolish or repair, or extend the time for complying with the order.

How to submit a Notice of Appeal

A completed Notice of Appeal must be submitted to the City Clerk or designate on or before the appeal deadline date indicated in the Notice or Order.

An appeal for a Property Standards Order to Comply must be submitted within 14 days of the date served on the Property Standards Order.
An appeal for a Notice issued on an application for, or to an existing business licence must be submitted within 30 days of the date issued on the Notice.

The non-refundable appeal fee of $445.00 must be submitted at the time of the application.

What to expect at a hearing

Meeting attendees must abide by the rules of procedure and Public Conduct Policy at meetings.
All interactions will be polite and respectful. Hearing attendees must maintain order and will not engage in unreasonable or offensive conduct, including insulting language or speaking disrespectfully at a meeting.
Appeals Committee meetings are open to the public. Agendas will be available on the City’s online meeting calendar.

Each party will have the opportunity to present their case and call witnesses.
Decisions will be rendered at the conclusion of the hearing.

Decisions

The Committee renders its decision in the presence of the public at the conclusion of the hearing.
The decision rendered by the Appeals Committee shall be final and binding.
A copy of the decision and the written reasons for the decision of the Appeals Committee will be sent to the Appellant by email and registered mail.
