Burlington City Council passed By-law 2020.494 to amend Zoning By-law 2020, as amended, on Jan. 28, 2025, under Section 34 of the Planning Act, 1990, as amended. File number: 520-13/24 (DGM-01-25)
By-law 2020.494 is a city-initiated zoning bylaw amendment that complies with changes made to the Planning Act regarding Additional Residential Units through O. Reg. 299/19, as amended, aligns with the City’s Housing Accelerator Fund Action Plan to boost housing supply, and implements Amendment No. 3 to the Official Plan of the City of Burlington, 2020.
Public consultation on the proposed zoning bylaw amendment occurred through a statutory public meeting held on Dec. 3, 2024, and a Committee of the Whole meeting held on Jan. 13, 2025. Notice of the statutory public meeting was published in the Hamilton Spectator on Nov. 5, 2024. Notice of the Jan. 13, 2025, Committee of the Whole meeting was published in the Hamilton Spectator on Dec. 14, 2024, and corrected on Dec. 28, 2024. The City received five comments and three delegations at the statutory public meeting held on Dec. 3, 2024, and three comments and no delegations at the Committee of the Whole meeting held on Jan.13, 2025.

Should you wish to appeal this bylaw to the Ontario Land Tribunal, you must file an appeal to the City Clerk by Feb. 19, 2025. Your appeal must include your objection to the bylaw and the reasons for this objection along with a cheque for $1,100, payable to the Minister of Finance. Only the applicant, specified person and public bodies as defined in the Planning Act, and registered owners of lands to which the bylaw will apply and who made submissions at this public meeting or who have made written submissions to the City before the bylaw is passed, will be able to appeal the decision of the City of Burlington to the Ontario Land Tribunal.
No person or public body shall be added as a party to the hearing of the appeal unless, before the bylaw was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
