
Nelson Aggregate Co. has made an application to amend the Official Plan for the lands located at 5235 Cedar Springs Rd. & 2226, 2232, 2244, 2280, 2292, 2300, 2316, and 2330 No. 2 Side Rd. The File Reference Number is 505-04/20.
Description of Proposed Development

Description of Proposed Amendments
The City of Burlington Official Plan (1997), as amended, designates the subject property as “Escarpment Rural Area”, which permits an array of rural uses including agriculture, single dwellings, forest and wildlife management, agriculture-related businesses and recreational use as provided in the Niagara Escarpment Plan (2017). The land use designation, as well as the permitted uses, remain the same throughout the City’s new Official Plan (2020, subject to appeals). A portion of the City’s Natural Heritage System is identified on the subject lands as identified in the new Official Plan (2020, under appeal).
The City’s Zoning Bylaw identifies the subject properties as ‘Niagara Escarpment Development Control’. This recognises that the Zoning Bylaw is not in effect and that the properties are subject to the policies of the Niagara Escarpment Plan as well as the requirement to secure a Niagara Escarpment Commission development permit.
The applicant is proposing to amend the Official Plan to redesignate the property from a ‘Escarpment Rural Area’ to a ‘Mineral Resource Extraction Area’ to allow for the expansion of the existing aggregate extraction use.
