Notice of Decision - Official Plan Amendment 161

With respect to an Official Plan Amendment
Subsection 17(34) of the Planning Act 

Date of decision: June 10, 2025
Date of notice: June 19, 2025
Last date of appeal: July 9, 2025 

A decision was made on the date noted above to approve Amendment No. 161 to the Official Plan of the City of Burlington. 

Purpose and effect of the amendment

The purpose of this amendment is to amend the existing “North Aldershot Commercial” and “Parkway Belt West Plan” designation of 1497-1511 Old Plains Rd. to permit 82 three-storey stacked townhomes. 

Public consultation was conducted between Feb. 26, 2025 and June 10, 2025. As a result of public consultation, the City received eight comments and one delegation at the Statutory Public meeting held on June 10, 2025. Comments received were considered as part of Council’s decision-making process.

Notice of Passing of Zoning Bylaw 2020.506

Burlington City Council passed Bylaw 2020.506 to amend Bylaw 2020, as amended, on June 10, 2025, under Section 34 of the Planning Act, 1990, as amended. File number: 520-04/25 (DGM-42-25) 

Bylaw 2020.506 rezones 1497-1511 Old Plains Rd. West to permit 82 stacked townhouse units as part of a phased proposal. 

Public consultation on the proposed zoning bylaw amendment occurred through a Statutory Public Meeting held on June 10, 2025, at a Committee of the Whole meeting. Notice of the Statutory Public Meeting was mailed to tenants and owners within 120m of the subject land on May 9, 2025, and published in the Hamilton Spectator on May 10, 2025. The City received eight comments on the proposed amendment and there was one delegation at the Statutory Public Meeting held on June 10, 2025.

Purpose and effect of the amendment

The purpose of this Official Plan Amendment (OPA) is to add certain elements of the text of the Burlington Official Plan, 2020 to implement the delegation of authority to staff to pass minor Official Plan and Zoning Bylaw amendments under Sections 17 and 39.2 of the Planning Act, that are minor in nature and in accordance with the City’s Delegated Authority Bylaw.

Burlington City Council passed Bylaw 2020.505 to amend Bylaw 2020, as amended, on June 17, 2025, under Section 34 of the Planning Act, 1990, as amended. File number: 520-07/25 (DGM-37-25) 

Bylaw 2020.505 rezones lands on 401-413 Brant St., 444-450 John St., 2002 and 2012 James St., to a revised development proposal on the subject lands.   

Public consultation on the proposed zoning bylaw amendment occurred through a Statutory Public Meeting held on June 10, 2025, at a Committee of the Whole meeting. Notice of the Statutory Public Meeting was mailed to tenants and owners within 120m of the subject land on May 13, 2025, and published in the Hamilton Spectator on May 17, 2025. The City received nine comments on the proposed amendment and there were three delegations at the Statutory Public Meeting held on June 10, 2025.
