Back to SearchBurlington City Council passed Bylaw 2020.455 to amend Bylaw 2020, as amended, on March 21, 2023, under Section 39 of the Planning Act, 1990, as amended. File number: 520-13/21 (PL-06-23)
Bylaw 2020.455 will permit temporary outdoor patio uses on private properties through a temporary use bylaw with a timeframe not to exceed three years from the date of the bylaw passing.
Public consultation on the proposed zoning bylaw amendment was provided between Feb. 16, 2023 and March 20, 2023. As a result of public consultation, the City received one public comment and no delegations at the Statutory Public Meeting held on March 20, 2023. Comments received were considered as part of Council’s decision-making process.

Should you wish to appeal this bylaw to the Ontario Land Tribunal, you must file an appeal to the City Clerk by April 12, 2023. Your appeal must include your objection to the bylaw and the reasons for this objection along with a cheque for $1,100, payable to the Minister of Finance. Additional information on the Ontario Land Tribunal process can be located at www.olt.gov.on.ca.

Only individuals, corporations and public bodies may appeal a zoning bylaw to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or group on its behalf.
No person or public body shall be added as a party to the hearing of the appeal unless, before the plan was adopted, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
