Description of Proposed Development
This application does not replace the historical OPA and ZBA that have been approved. This application seeks to modify those in-effect zoning in order to permit a development concept that has been prepared in response to the current status of the housing market.
This application seeks to establish reduced parking rate, reduced second floor building height, reduced setbacks to parking structure, and an additional metre in overall building height.

Description of the Proposed Amendment
The City of Burlington Official Plan (1997), as amended, designates the subject property as ‘Downtown Mixed Use Centre’ and ‘Downtown Core Precinct’, subject to Official Plan Amendment No.113.
OPA No. 113 permits an 18-storey mixed use building with a FAR of 8.4:1.
The site is zoned as ‘Holding - Downtown Core (H-DC-489) which may permit an apartment building, retail, service commercial and/or office space on second storey, retail/service commercial on first floor, max FAR of 8.4:1, balcony encroachments for floors 4 to 17 and no encroachments for floors 2 and 3, max building height of 18 storeys and 65m, max floor heights of 4.7m at floor 1 and 3.8m for floor 2, max floor area of 760 square metres for the 7th storey and above, max glazing percentage of 25% for the ground level facing John Street, a 5m x 5m visibility triangle at the southwest corner of James and John and 16m x 16m at Brant and James, 18 square metres of amenity space per residential unit.
The applicant is proposing to amend the Zoning By-law by amending the existing site-specific exception (H-DC-489) in order to establish permission for reductions to the parking rate, reduced second floor building height, reduced setbacks to parking structure, and an additional metre in overall building height
