Burlington City Council passed By-law 23-2025, on April 15, 2025, under subsection 28 (4) of Part IV of the Planning Act, 1990, as amended. File number: 590-01-25, (DGM-24-25)
By-law 23-2025 adopts the Affordable Rental Housing Community Improvement Plan (CIP) for the Burlington Affordable Rental Housing Community Improvement Project Area. A copy of the adopted CIP is available on the City’s Housing Strategy webpage at www.getinvolvedburlington.ca/housingstrategy
Public Consultation on the Affordable Rental Housing Community Improvement Plan occurred through a Statutory Public Meeting held on April 8, 2025, at a Committee of the Whole meeting. Notice of the Statutory Public Meeting was posted on the City’s Public Notice page on March 8, 2025, and published in the Hamilton Spectator on March 8, 2025. The City received three comment letters on the Affordable Rental Housing Community Improvement Plan, and there were three delegations at the Statutory Public Meeting held on April 8, 2025. Comments received were considered as part of Council’s decision-making process.
The Burlington Affordable Rental Housing Community Improvement Plan is exempt from approval by the Minister. The decision of the council is final if a notice of appeal is not received on or before the last day for filing a notice of appeal.
Should you wish to appeal this bylaw to the Ontario Land Tribunal, you must file an appeal to the City Clerk by May 14, 2025.
Your appeal must include your objection to the bylaw and the reasons for this objection along with a cheque for $1,100, payable to the Minister of Finance. Additional information on the Ontario Land Tribunal process can be located at www.olt.gov.on.ca.
Only the Minister, and a specified person, a public body, or a registered owner of land to which the by-law would apply, and who made submissions at a public meeting or who have made written submissions to the City before the plan was adopted will be able to appeal the decision of the City of Burlington to the Ontario Land Tribunal.
No person or public body shall be added as a party to the hearing of the appeal unless, before the bylaw was adopted, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
