
On Dec. 10, 2024, Burlington City Council passed Community Benefits Charge Bylaw 81-2024, which applies to all lands in the City of Burlington, under section 37 of the Planning Act, R.S.O. 1990, Chapter P.13, as amended. Bylaw 81-2024 establishes community benefits charges for the City of Burlington and repeals Bylaw 66-2022.
Bylaw 81-2024 is effective as of Jan. 1, 2025, and imposes community benefits charges on residential high-density developments and redevelopments upon all lands within the boundaries of the City of Burlington as shown on the map.
Community benefits charges are levied at the prescribed rate of 4% of land value against high-density development or redevelopment of buildings with five or more storeys and 10 or more residential units for development-related capital expenditures.
Any person or organization may appeal the Community Benefits Charge Bylaw to the Ontario Land Tribunal (OLT) pursuant to Section 37(17) of the Planning Act, 1990. File a written notice of appeal setting out the objection to the bylaw, and the reasons supporting the objection, with the Clerk of the City of Burlington, 426 Brant St., Burlington, Ont., L7R 3Z6 no later than 4:30 p.m. on Jan. 20, 2025.
